The original application PA 24/00154/B sought retrospective approval for adding a fifth container and widening the walkway, plus varying conditions of prior permission PA 22/00757/B to allow permanent retention of spectator facilities between TT and Festival of Motorcycling events. It was refused by Planning Committee on 25/11/2024 for lack of overriding national need, poor visual quality harming the AHLV countryside character, and insufficient flood risk information. Appellant argued national importance for TT events per VES, minimal visual impact due to topography and below-road siting, precedents of public sector containers/boardwalks, unreasonable removal conditions, and low flood risk. Inspector found permanent containers cause unacceptable harm to countryside/AHLV despite TT benefits (unlike prior marshal appeal), no flood risk assessment provided, and other benefits insufficient to outweigh policy conflicts. Appeal dismissed on 09/04/2025, upholding refusal reasons.
Precedent Value
Reinforces strict AHLV/countryside protection requires clear overriding national need with no alternative; distinguishes essential safety infrastructure from spectator amenities. Applicants must provide FRA in flood zones and demonstrate permanence essential, not just supportive.
