The original application PA 04/00349/A for approval in principle to create two residential building plots with access via the Castletown By-pass was refused by the Planning Committee and upheld on review solely due to road safety concerns over a new access onto the A5 strategic route (50mph limit) and an uncontrolled railway crossing. The appellant argued the access was safer than previously rejected alternatives, supported by recent heavy vehicle use during IRIS works, good visibility, and existing rights, while proposing conditions for speed limit extension. The Council defended the refusal citing prematurity relative to the emerging plan and DoT objections to additional accesses on strategic routes. The Inspector acknowledged diminished weight of the 1991 plan and limited weight for the early-stage emerging plan but found the access prejudicial to safety on the strategic A5 via uncontrolled crossing, distinguishing it from agricultural or temporary uses, recommending dismissal. The appeal was dismissed, upholding the refusal.
