General Policy 2
GP2 permits development in accordance with local plans and other policies provided it respects site/surroundings in siting/layout/scale/design/landscaping (b), avoids adverse effects on townscape character (c), avoids adverse effects on local residents' amenity (g), provides safe/convenient access and avoids adverse effects on road safety/traffic (h,i), and considers safety/security (m). The inspector tested the proposal against these, finding visual/amenity/highway benefits from garage removal, landscaping, fencing, parking, paths and lighting in the untidy residential site, with no material harm.
Time limit
The development hereby permitted shall commence before the expiration of four years from the date of this notice.
Approved drawings
This permission relates to the replacement of the existing garages with planted public space, the erection of fencing and the creation and alteration of pedestrian footways, all as shown on Drawing Nos. 40, 41 Rev A, 42 Rev A and 102 Rev D (all received on 22 November 2012).
Landscaping scheme
No development shall take place until full details of the proposed landscape planting and tree planting have been submitted to and approved in writing by the Planning Authority. These details shall include planting plans and schedules of plants, noting species, plant/tree sizes and proposed numbers/densities of plants.
Landscaping implementation and maintenance
All planting, seeding or turfing comprised in the approved details of landscaping must be carried out in the first planting and seeding seasons following completion of the development. Any trees or plants which within a period of 5 years from the completion of the development die, are removed or become seriously damaged or diseased must be replaced in the next planting season with others of similar size and species.

SupportAt a meeting of the Board dated 3/12/12, the following application was considered, and I am directed to advise that it has been approved; 12/01555/B
The original planning application (12/01555/B) involved land owned by the Department of Infrastructure in Janet’s Corner, Castletown, and was referred to the Council of Ministers under Article 10 of The Town and Country Planning (Development Procedure) Order 2005. The proposal included demolishing underused garages and a redundant substation, creating new landscaped open space, 13 parking spaces, upgraded footpaths, new fencing, street lighting, and a pedestrian link between 12 & 13 Orry Place. The applicant argued the scheme would improve visual amenity, parking provision, pedestrian safety, privacy, and security compared to the existing poor condition of the site. The inspector assessed impacts on character/appearance, resident amenities, and highway safety/convenience under General Policy 2 of the Strategic Plan, concluding the proposal would enhance all these aspects with no identified harm. The inspector recommended approval with conditions including time limits, approved drawings, and detailed landscaping submission.
Precedent Value
