The original application for a detached bungalow on a disused non-agricultural depot site in open countryside was refused under delegated powers for unsustainability, conflict with countryside protection policies, and poor design. The appellant argued the site qualifies as previously developed land (PDL), is sustainable with good access to services, buses and footpaths, design responds to locality and prior refusals, supported by precedents and family ties. The inspector found only slight policy conflict due to PDL status, net environmental benefit over current hardstanding, good highway safety subject to conditions, and minimal visual harm. Appeal allowed despite measure of conflict with GP3 and EP1, as benefits outweighed harms.
Precedent Value
Demonstrates PDL redevelopment in countryside can succeed via net environmental gain, sustainability evidence and minimal harm, even without buildings; policies weighed holistically with personal circumstances. Applicants should provide robust transport/access data and secure neighbour consents early.
