The original application for ground floor extension and alterations plus conversion of roof space by raising the roof, adding dormers and rooflights was refused by the Department of Environment, Food and Agriculture (Acting Head of Development Management) primarily for creating a dominating feature disrupting streetscene openness and overbearing impact on neighbours. Appellants argued the design was sympathetic, cited mixed surrounding character, neighbour support, sustainability benefits and precedents. The inspector agreed with the Council on visual harm to the bungalow group at the estate entrance but disagreed on neighbour amenity impacts after site visits, finding no unacceptable overlooking, loss of light or overbearing effects. The appeal was dismissed as harms to character under IMSP policies and RDG outweighed family housing benefits. Minister accepted the recommendation on 19 February 2025.
Precedent Value
Corner plot bungalows at estate entrances have high protection for low rooflines maintaining openness; amenity arguments can succeed on appeal with evidence but character harms decisive under IMSP/RDG. Applicants should prioritise hipped/subordinate designs or single-storey alternatives.
