No ObjectionDo not oppose
The original application 08/01946/B for conversion of a barn to a dwelling was permitted on 15 January 2009, but the appellant (agent for Mr A Walker) appealed Condition No. 5 of the approval notice on 29 January 2009. Notification letters were issued on 2 February 2009 indicating the appeal was accepted and would be referred to an independent person appointed by the Council of Ministers, with a request for the council's statement of case issued on 4 February 2009 anticipating a public inquiry. On 16 February 2009, the appeal was withdrawn by the applicant's agent. The original permission therefore stands without modification to Condition No. 5.
Precedent Value
No precedent value as the appeal was withdrawn at an early stage before any independent person review or determination. Future applicants should ensure appeals against conditions are fully prepared before lodging, as withdrawal leaves the original permission unchanged.
