Officer's Report
The Site
The site represents the curtilage of an existing property which is situated to the south of the A5 Castletown Road, to the east of the B26 road which links the A5 to the Old Castletown Road (A25). The property was formerly an agricultural dwelling (see history below) and sits to the east of a courtyard of farm buildings which have permission for conversion to a dwelling, works for which are well underway. The property is a detached dwelling with sizeable gardens on all sides. Further to the south, separated by fields outwith the application site, is the steam railway line.
Planning Status
The site lies within an area designated as Woodland within a wider area of an Area of High Landscape or Coastal Value and Scenic Significance on the Isle of Man Planning Scheme (Development Plan) Order 1982.
Planning History
A certificate of lawfulness was granted in respect of the residential use of the agricultural dwelling under PA 06/0299/LAW. Since then, the new owners requested permission for alterations and the 16 June 2008
erection of garaging with a granny flat above under PA 06/1878 which was refused and a further application was submitted and permitted under PA 07/1422.
The Proposal
Now proposed is the erection of decking on the western elevation, alterations to the space on the eastern side of the property alongside the garage, slight outward extension on the western elevation at first floor level and the alteration of the roof structure on the rear elevation with gable ends rather than hipped ends as was approved previously. Internally, what was to be a sitting room is now to be a kitchen and living room.
Representations
The Isle of Man Fire and Rescue Service recommends installation of smoke detection which is a matter for the Building Regulations not planning.
Department of Transport Highways and Traffic Division recommend that they have no objection to the proposal.
Assessment
The proposed changes do not increase the amount of accommodation which has been permitted and do not have any adverse impact on the appearance of the property.
Party Status
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
The Fire Prevention Officer requests the installation of smoke detection which is dealt with as part of the Building Regulations and as such is not a planning matter. The Fire Prevention Officer should not be afforded party status in this instance.
