The site represents the curtilage of a dwelling which lies on the southern side of a lane which runs east from the Ballavale Road, to the south of the A5 Castletown Road.
The site lies within an area designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 as Woodland within a wider area of High Landscape Value and Scenic or Coastal Significance.
Planning permission was sought and granted for the erection of the existing dwelling under IDO 37410 in 1974. This permission was granted subject, inter alia conditions which restrict the occupancy of the dwelling to those employed in agriculture and that the dwelling may not be severed from the agricultural holding. This holding represented an area larger than the curtilage of the dwelling now defined. As such this condition would appear to have been breached. However we have received advice in the past that such conditions are not enforceable and as such are invalid conditions.
Most recently, a Certificate of Lawfulness was granted in respect of the residential use of the property (06/0299/LAW). Permission was refused for alterations to the dwelling and the erection of a three car garage with granny flat above (PA 06/1878).
Proposed now are alterations to the dwelling - effectively building above the existing garage and extending out in front in single storey form to provide a garage, rearward extension of the rear elevation in a tile-hung finish, replacement of many of the windows with new timber framed large glazed apertures in the rear elevation replacing the large modern windows.
Also proposed is the filling in of the existing cattle grid at the entrance to the site.
The Society for the Preservation of the Manx Countryside and the Environment suggest that they are "concerned" at the size of the extensions, particularly as the property was once tied to agricultural occupancy.
The Isle of Man Fire and Rescue Service recommends the installation of domestic smoke detection.
The Mea recommend the attachment of notes regarding existing electrical supplies within the site.
The proposal results in a larger property and one with a greater massing than the existing with its single storey annex but not one which is unattractive or inappropriately large. The Island Strategic Plan contains policies regarding the extension of traditionally styled properties and the extension in an inappropriate form of non-traditional properties, neither of which apply in this case. As such, there are no policies regarding this amount of extension of a non-traditional but not unattractive existing dwelling in the countryside.
The dwelling may be seen from the steam railway line but the visual impact of the proposed extensions is not unacceptable therefrom.
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
The Society for the Preservation of the Manx Countryside and the Environment is not directly affected by the proposal and as such should not be afforded party status in this instance.
The Isle of Man Fire and Rescue Service raises issues which are the responsibility of the Building Regulations and as such should not be afforded party status in this instance.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This permission relates to the alterations and extensions shown in drawings 1125-00, -01, -02, -03, -04B, -05B, -06 all received on 31st July, 2007.
N 1. The Chief Fire Officer recommends the installation of mains wired interconnected domestic smoke detection.
N 2. The applicant is advised that there are Underground Cables/Overhead Lines present in the area indicated in the planning application. Please contact Anthony Kinrade or Ian Horsey, Operations and Maintenance Department, Network Services, Manx Electricity Authority, (Tel. 687687) to discuss working practices around Cables and Overhead Lines which may be required to be diverted before any work can be carried out on site.
The applicant is also advised to contact the Manx Electricity Authority for Electrical Site Safety 5 documents, (Tel. 687766), before any work is carried out on site. All work to be carried out with reference to Health and Safety Executive Guidance Notes HS(G)47 and GS6.
