In pursuance of powers granted under the above Act and Order the Department of Local Government and the Environment does hereby APPROVE the following application made on behalf of:

which was considered on 4 May 2006, subject to compliance with the conditions specified below.

Schedule Of Conditions:
- This permission relates to the erection of an apartment building with landscaping and parking and the window and balcony details together with access and ventilation all as shown in drawings received on 16th February, 2006.
- The development hereby permitted shall commence before the expiration of four years from the date of this notice.
- The development must be phased as described in plan reference 327 received on 16th February, 2006.
- The windows and balconies must be installed as shown in drawings reference 322, 323A and 324A all received on 16th February, 2006.
- All planting, seeding or turfing comprised in the approved details of landscaping must be carried out in the first planting and seeding seasons following the completion of the development or the occupation of the dwellings, whichever is the sooner. Any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased must be replaced in the next planting season with others of a similar size and species.
- No apartment may be occupied before the access roads, footpaths and parking areas have been provided to the satisfaction of the planning authority after consultation with the highway authority.
- The existing access for public service vehicles to the rear of the properties to the east of the site shall be retained.
- Notwithstanding the provisions of any Permitted Development Order for the time being in force, the enclosure of balconies is not permitted without prior express planning approval.
NOTE This applicant should consult the Fire Safety Department as the flats must comply with the Housing (Flats) Regulations 1982. It will thereafter have to be registered under the same regulations.
NOTE Prior to the commencement of work the applicant must discuss with the MEA the high and low voltage electricity cables which cross the site.
This decision was made by the Director of Planning and Building control in accordance with the authority delegated to him under Article 3(13) of the Town and Country (Development Procedure) Order 2005
This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005.
Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

You should note that a copy of the Officer's report which led to the decision being made, along with any correspondence relative to the application, is available for inspection at the Department.
The proposed development must not be commenced until either;
- The time for requesting an appeal has expired; or
- Any appeal has been determined;
Whichever is the later.
