The application site comprises of the curtilage of a semi-detached dwelling located within Lezayre Park, which is an established residential area within Ramsey.
The proposed development comprises of the enlargement of a previously approved dormer window on the rear roof slope of the dwelling. The proposal effectively equates to an amendment and addition to previous approved planning applications.
The application site has been the subject of two previous planning applications that I consider to be of relevance to the assessment of this current planning application.
PA 02/01741/B – Alterations and extension to dwelling, 65 Lezayre Park, Ramsey. The planning application was initially considered and approved on the 6th January 2003, with the initial approval decision notice issued on the 8th January 2003.
PA 05/00645/B – Amendments to an approved car port and extension (02/01741/B) to provide an enclosed garage and a new front entrance at 65 Lezayre Park, Ramsey. The planning application was initially considered and approved on the 17th June 2005, with the initial approval decision notice issued on the 23rd June 2005. The decision was taken to review and this was considered by the Planning Committee at their meeting on the 19th August 2005. The Planning Committee resolved to confirm their initial approval and the review approval decision notice was issued on the 25th August 2005. In accordance with the recommendation of the appointed Planning Inspector the Minister dismissed a subsequent appeal and confirmed the approval on the 8th December 2005.
Ramsey Town Commissioners have no objection to the planning application.
The owner and/or occupant of 63 Lezayre Park objects to the planning application. The grounds for their objection can be summarised as concern that the proposal will lead to unacceptable overlooking and subsequent loss of privacy.
To date no comments have been received from the Department of Transport Highways Division. However given the nature of the proposed development I would suggest that there are no highway implications.
The application site is located within an area that is recognised as being within predominantly residential use under the Ramsey Local Plan. I do not consider there to be any specific policies that are relevant to the assessment of this current planning application.
I had deferred making any decision on this planning application until the outcome of the appeal against the previous planning application, 05/00645/B, was known. This has now been received and its implications can be assessed. I have placed a copy of the appeal decision on the planning application file.
The report of the appointed Planning Inspector into the previous planning application basically concluded that the combination of the scale of the proposal and the relationship of the dwellings was such that the impact of the development would not cause unacceptable harm to the neighbouring properties.
The development proposed by this planning application comprises of extending a previously approved dormer window on the rear roof slope of the dwelling towards the adjoining dwelling that makes up the other part of the semi. This is moving away from 63 Lezayre Park.
I consider the proposed dormer window to be a relatively normal form of development and do not consider the amenity of any of the surrounding properties to be unacceptably affected by it. Accordingly, I recommend that the planning application be approved.
I consider that the following meet the criteria of Government Circular 1/06 and should be afforded interested party status:
