Initial Refusal Decision Notice
Town and Country Planning Acts, 1934 - 1991
Isle of Man Planning Scheme (Development Plan) Order 1982
Mr William Barry Vannan Cronk Naquill Old Laxey Hill Laxey IM4 7DA
In pursuance of powers granted under the above Acts and Order the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:
Name: Mr & Mrs Ronald Herbert Cain Proposal: Removal of agricultural workers condition from dwelling at: Three Acres Ballafreer Lane Union Mills Isle Of Man IM4 4AS
which was considered on 15 July 2005, for the reasons set out below.
Date of Issue: 25th July, 2005 Murray House Mount Havelock Douglas Secretary Planning Committee
Reasons For Refusal:
- The Planning Committee is not persuaded that sufficient evidence has been produced to indicate that the agricultural condition has not been complied with since the house was erected and no evidence has been submitted to indicate that the property is no longer required for occupation by an agricultural worker or person whose latest employment is or was in agriculture in the island. Accordingly the removal of the agricultural workers condition is insufficiently justified.
- This decision was made by the Planning Committee constituted in accordance with Paragraph 2 of Schedule 1 of the Isle of Man Planning Scheme (Development Plan) Order 1982.
