The original application 03/00084/B proposed erection of three mews dwellings with integral garages replacing an existing dwelling and was refused by the Planning Committee on review. Forest Homes LTD, represented by M P Associates, appealed on 17 November 2003 under the written procedure. The appeal was deferred at the appellant's request and held in abeyance alongside another appeal. In December 2005, the appellant informed the Chief Secretary's Office they wished to withdraw the appeal. Consequently, the Planning Committee's refusal decision stands.
Precedent Value
This appeal demonstrates that appellants can request deferrals but must actively manage the process to avoid automatic upholding of the refusal upon withdrawal. Future applicants should ensure appeals are progressed promptly or formally withdrawn to prevent unintended delays.
