This application is being recommended for consideration by the Planning Committee rather than being considered under delegated powers as the application is being recommended for approval contrary to the recommendations of the local authority, and also the site has been the subject of a number of appeals and has a long and sensitive planning history.
The site represents an approved plot within a developing estate of dwellings situated between Bridge Road, the Silverburn River and Silverburn Estate. The plot has a rear boundary with the rear of 46 and 47, Fuchsia Grove and 64, Beech Grove. 47, Fuchsia Grove has a gable end facing towards the application property and is some 19m from the rear of the application dwelling. Number 64, Beech Grove does not face directly towards the application property but has bedroom windows which are contained within a rear annex which is the closest part of the existing property to the application property which is 16m away from the boundary. Number 46, Fuchsia Grove sits parallel with the boundary to the application site and will be some 11m from the rear of the new property.
The site lies within an area of Existing Predominantly Residential use on the Isle of Man Planning Scheme (Development Plan) Order 1982.

Proposed now is the erection of a garage attached to the dwelling. The garage will be 4 m wide and 6 m long and will have a ridge which is lower than the main ridge by 1 m . The garage will be finished in painted render to match the finish on the main dwelling. The dwelling itself differs in appearance from that approved under PA 05/0454 in that whilst the height and pitch of the roof of the main house is the same, there is to be accommodation within the roofspace, ventilated and lit by a new window in the front gable and instead of three rooflights in the southern pitch there are to be two and a new rooflight in the northern pitch which was not previously proposed. The accommodation in the roofspace comprises two en-suite bedrooms, one replacing a bedroom lost on the ground floor through the introduction of the staircase to the upper floor.
Malew Parish Commissioners indicate that they consider the application to result in an over-intensive use of the site
Department of Transport Highways and Traffic Division raise no objection to the application
The Ballasalla and District Residents' Association object to the application as the erection of the garage would increase the density of the site which has previously been an issue at appeal and that this may establish an unfortunate precedent for further garages within the development.
Department of Transport Drainage Division raise no objection subject to conditions.
The proposed garage is a modest structure, set back from the main frontage of the dwelling by 3.7 m and the inclusion of the roof accommodation will not change the size or impact of the dwelling. The width and mass of the rear of the property will increase, but only marginally and the impact of this on the two properties to the rear which are closest to the garage - 64, Beech Grove and 47 Fuchsia Grove will not be so affected to warrant refusal of the application.
Whilst the density of development on the plot will increase as a result of the addition of the garage and this could be used in support of further applications for extension (in fact those new applications for plots 6 - 10 inclusive (see Planning History above) all include garaging within the new dwelling types), the plots within this estate should not be treated any differently from other residential areas. It should be noted that there is a current application for extension of a property in Silverburn estate, immediately alongside the application estate - PA 09/0248 proposes to extend 64, Beech Grove and there are no objections from within the estate or from the residents' association in respect of the principle of this. This application has been permitted.
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
BADRA are a residents' association which are not directly affected by the proposal and should not be afforded party status in respect of this application.
