Dear Sirs, RE : Proposed retention of existing marquee at "Barroose House", Barroose Road, Baldrine, Lonan. Isle of Man. IM4 6AR. (Retrospective application)

Please find enclosed copy of our planning application prepared in connection with the above. Our clients wish to obtain retrospective planning approval for retention of their existing previously approved Marquee at "Barroose House". The application is a "follow on" from a previous planning application that granted approval for the marquee on the 8th November 2006 (PA05/02025/R) at appeal. The marquee was approved and confined for dog agility training purposes, for the applicant's sole use and for a maximum period of 5 years.

The current application is to obtain approval to retain the marquee for a further limited period of time (preferably a further 5 years) but to be determined and agreed by the planning authorities. The applicants are prepared to accept similar conditions to those included on the original planning permission, in particular, the condition relating to the personal use of the marquee.

It is relevant that the applicants have "Barroose House" on the market at the moment and have been trying to sell the property for some time without success. Had the property been sold the marquee would have been removed from site by now. In the event that a purchaser was to be found within any new approval period, the applicants would be prepared demolish and remove the marquee from site on completion of that sale. We would suggest that a planning condition pertaining to this effect could be included within an approval, if required by the planning department.

We have included within the submission, a copy of the planning appeal inspectors report relating to the previous approval of the marquee (PA05/02025/R) The appeal inspector determined that the proposal at that time was acceptable in the current location and went on to state:

"The site is in an area that is not designated as being of high landscape value" "Whilst visible from public viewpoints, despite its size and the whiteness of the canvas cladding, the structure is not an obtrusive feature in the landscape. This is because it is rather distant, within a group of buildings, has a backdrop of mature tress and matches the predominant white colour of the external finishes of Barroose House" "The photographs on file show that even in winter the enclosure provided by the mature trees within the application site contributes significantly to the visual integration of the structure into the landscape. The applicants are proposing to retain these tress and are willing to accept a condition to this effect"

The inspector also concluded that the marquee would not have a significant impact on the rural character and appearance of the area.

The marquee is effectively screened from public view to a large extent by the mature trees that have been retained at the site and by existing adjacent buildings. It is relevant that there has been additional screen planting added to the perimeter of the marquee site since the initial approval, which has improved the current screening situation.

Please note that the container number 3 indicated on the drawings is to be removed as part of this application. A separate independent planning application has been submitted for the lawful use of the existing portakabin and the 2 storage containers numbered 1 and 2 on the basis that they have been in situ for a period in excess of 4 years.

The applicants are keen dog enthusiasts and compete in dog agility trials at National level both within and off the Island throughout the year. The current covered training facility is essential to them for dog training purposes during the winter periods, especially during dark evenings and extreme weather conditions.
