The officer assessed the proposal against the presumption against development in countryside (Environment Policy 1) but found it acceptable under Environment Policy 21 for buildings for shelter or car…
Environment Policy 1
Protects countryside from development unless overriding national need and no alternative; officer noted general presumption against but special needs justified exception, relying on 2006 inspector findings of no significant impact.
Environment Policy 21
Permits buildings for stabling/shelter/care of animals in countryside if not detrimental to character in siting/design/size/finish; officer judged marquee acceptable as it met this test per 2006 appeal, with white materials reflecting purpose without cavity walls.

Do not oppose; has no traffic management, parking or road safety implications
Lonan Parish Commissioners recommend refusal of the application for retention of the marquee citing unchanged circumstances from prior refusal and visual impact concerns, while Highways Division does not oppose due to no traffic implications.
Key concern: dominates the existing dwelling and is a visual scar on the surrounding countryside
Lonan Parish Commissioners
Objectionthe Board recommends refusal of the above Planning Application, on the grounds detailed below; absolutely nothing has changed since the original retrospective application was approved; It lacks justification, It dominates the existing dwelling and is a visual scar on the surrounding countryside when viewed from the main road, and beyond, Approval of a temporary structure could allow the applicants to argue the case for a permanent structure as originally applied for and refused
Highways Division
No ObjectionDo not oppose has no traffic management, parking or road safety implications
The Planning Committee refused retrospective approval for a 24m x 16m marquee in the curtilage of Barroose House in open countryside, citing lack of agricultural justification and harm to visual amenity under Laxey and Lonan Area Plan policy L/OSNC/PR/1. The appellant argued the marquee met special needs for national-level dog agility training, was temporary, non-commercial, well-screened, and comparable to equestrian uses allowed under emerging policies. The inspector accepted the unique rural needs of the use, found minimal visual impact due to screening and context, distinguished it from a prior refused permanent shed appeal (AP 2218), and recommended allowance with strict conditions limiting use to private dog training for 5 years and tree protection. The recommendation reversed the Committee's refusal.
Precedent Value
Establishes that non-agricultural recreational animal training with unique spatial/weather-protected needs can justify temporary structures in non-designated countryside if visual impact minimal and conditioned. Future applicants should emphasise functional necessity for rural siting, provide screening evidence, and offer time-limited personal-use conditions.
