The Planning Committee granted approval for demolishing existing unauthorised buildings and erecting a two-storey general purpose storage building for leisure activities on fields 2166 and 2205, Sky Hill, Lezayre. Lezayre Parish Commissioners appealed, arguing unacceptable intrusion into AHLVSS, unsuitable access, harm to Millennium Way amenity, and lack of proper plans. The applicant and Committee defended the proposal as screened, necessary for authorised leisure use, and visually acceptable when set into the hillside. The inspector found the site authorised for leisure for 15 years, existing structures immune from enforcement, and the proposal screened from viewpoints, recommending the appeal fail. The Minister accepted this, dismissing the appeal and upholding approval with reinforced conditions.

This appeal shows that in AHLVSS, proposals replacing long-standing structures for authorised uses can succeed if robustly screened by natural features; future applicants should provide precise location plans and accept detailed conditions, while parishes must provide convincing evidence beyond general amenity fears.
