The Planning Committee rejected the officer's recommendation for approval, finding 'insufficient justification for a building of the size and massing proposed within a residential curtilage in an area…
General Policy 2
Requires development in undesignated open areas (white land) only where in accordance with policy. Officer assessed proposal as compliant due to ancillary storage need, limited visual impact, and temporary nature not adding to dwelling massing. Committee disagreed, finding over-development without justification in residential curtilage following prior large-scale replacement.
Environment Policy 1
Protects countryside from inappropriate development. Site part-residential curtilage, part paddock on white land with presumption against development. Officer found no adverse countryside impact due to screening and lower height than dwelling. Committee found size/massing unjustified and detrimental despite temporary intent.
Recommend approval as the proposal has no adverse highway impacts
Registers an interest in the application (no objection stated)
Andreas Parish Commissioners objected to the proposal citing its permanent appearance, removal difficulties, and countryside impact; Highways Division had no objection; E J Callow initially objected but later withdrew concerns after site visit; one neighbour noted interest without comment.
Key concern: permanent appearance of temporary structure and countryside impact
Andreas Parish Commissioners
ObjectionThe plans appear to be misleading in that far from being a temporary structure, the materials of the building and the design thereof would indicate that is to be a permanent structure.; The height of the building is also likely to be detrimental to the surrounding countryside, and therefore not in keeping with the area.
Highways Division
No ObjectionRecommend approval has no adverse traffic management, parking or road safety implications
E J Callow
Conditional No ObjectionSurely policy only allows for such a building where an agricultural need has been demonstrated. No justification has been provided in this instance; I feel it's very likely that any 5 year promise to remove the building given with this application would be contested by any future owner. Surely the building is either allowed or not. If the Authority does agree to go against policy and approve it, I would appreciate its removal, and that of any 'temporary' access, be secured by legal agreement at the outset
Conditions requested: no surrounding land turned to hardstanding other than areas shown (no allowance for helicopter pad); shed and doors coloured in 'Moorland green' and maintained; removal of building and temporary access secured by legal agreement at outset; demonstrate residential curtilage boundary and aircraft landing area
