General Policy 2
Requires development to respect the site and surroundings, not adversely affect landscape/townscape character, and provide appropriate safe access with adequate parking/servicing. The Inspector found no conflicts, as the layout complied with parking requirements, access was satisfactory from the estate road, design reflected nearby buildings with similar cladding, and it incorporated visual interest via the glazed entrance.
Strategic Policy 3 - To respect the character of our towns and villages
Identifies Jurby as a Service Village where Area Plans should maintain/increase employment opportunities. The proposal broadly reflected this by providing an industrial unit in the Industrial Estate context, supporting regeneration and employment growth.
Time limit
The development hereby permitted shall commence before the expiration of four years from the date of this notice.

This permission relates to the erection of an industrial building and associated landscaping and parking, as shown on Drawing Nos. 11 0883/01, 11 0883/02, 11 0883/03, 11 0883/04 and 11TS019-01, all received on 6th January 2012.

The original application (12/00015/B) for a new factory unit by Nasaleze Ltd on an undeveloped plot in Jurby Industrial Estate was assessed in the context of prior approval (PA 10/0587) for a smaller unit on the same site. The Planning Statement noted conflicts with 1982 Airfield and AHLVSS designations but recommended approval based on the industrial context, Strategic Plan support for Jurby regeneration, and prior precedent. The inspector concurred, giving little weight to outdated designations due to surrounding industrial uses and prior approval, finding the proposal compatible visually and in land use terms with no policy conflicts under General Policy 2. Parking and access complied with standards, and the design was acceptable. The appeal was allowed subject to conditions on commencement and approved drawings.
Precedent Value
This appeal reinforces that prior approvals can establish development principle on contentious sites, with little weight given to outdated landscape/airfield designations in established industrial contexts. Future applicants should emphasise Strategic Plan support for employment in designated areas like Jurby and cite relevant precedents.
