The application site is the residential property of No.25 All Saints Park. The application site is a corner plot. To the north west of the application site is No.23 All Saints Park. The area is zoned as proposed residential within the Laxey and Lonnan Local Plan. The site is not located within a Conservation Area.
This application is seeking permission to erect a rear conservatory. The conservatory will project 3.7m to the rear of the property and will be 3.5m in width.
Within the adopted Isle of Man Strategic Plan 2007, the following policies are considered to be relevant in the determination of this application: General Policy 2, Paragraph 8.12.1
There have been a number of previous planning applications that are considered material to the assessment of this current planning application.

Lonan Parish Commissioners recommends approval of the application. Highways Division of the Department of Infrastructure do not oppose the application Isle of Man Water and Sewerage Authority do not object to the application.
In respect of the impact on the residential environment of No.23 All Saints Park, the application site is set to the south east of the neighbouring property. The proposed conservatory will be set 1.4m off the boundary of No.23 All Saints Park. The conservatory will project 2.8m beyond the rear elevation of the neighbouring property. Due to the projection and siting of the conservatory, it is considered the proposed conservatory will no result in demonstrable harm to the residential environment of No.23 All Saints Park in terms of overshadowing and loss of light; however, the application is proposing to install windows into the north west facing elevation of conservatory, which will look towards the neighbouring property. It is considered a condition is attached that requires these windows to be obscure glazed so as to prevent any overlooking and loss of privacy from occurring.
In respect of the impact on the visual amenities of the locality, the conservatory will be visible from public highway to the south east of the application site. The conservatory will be set 6.5m away from the boundary, measured at its closest point. The conservatory will have some impact on the visual amenities of the locality but not to a degree to warrant a refusal.
It is recommended that planning permission be granted subject to conditions.
The local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
The Highways Division is part of the Department of Infrastructure of which the planning authority is part of. As such, the Highways Division cannot be afforded party status in this instance.
Isle of Man Water and Sewerage Authority have not commented on planning matters and as such should not be afforded party status.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This permission relates to the erection of a conservatory as shown in drawing numbers 01, 02, 03, 04 and 05 date stamped 24th July 2011 and drawing number 06 date stamped 1st September 2011.
C 3. The windows to be formed in the north west facing elevation of the conservatory must be glazed or re-glazed with obscure glass only.
I confirm that this decision accords with the appropriate Government Circular delegating functions to Director of Planning and Building Control / Development Control Manager.
