Evidence of 10-year use
The evidence sufficiently demonstrates that the use for storage and distribution (Class 2.4) of the site, which is the land (hardstanding area shown on drawing SM25/637/1) and buildings (annotated Nrs 1, 2 & 3 on drawing SM25/637/1) to the east and adjacent to Close Lake Bungalow, Jurby Road, Andreas and has been in use/in place for more than 10 years and as such, the Department may not issue an enforcement notice due to the provisions of Town and Country Planning Act 1999 Section 24 and Schedule 4 Part 1 paragraph 3(a).
