Planning permission was granted for installation of two boreholes with subterranean storage tanks at Bishopscourt Mansion House, a Registered Building under renovation. Neighbour Mrs Brenda Cannell of Garden Cottage appealed the approval, citing risks to structural integrity, noise/disruption from ongoing works, historical significance, environmental concerns, and lack of risk assessment. The Council defended the approval, arguing compliance with IMSP policies, no structural risk at 50m distance, and benefits for sustainable water supply. The Inspector found no evidence of structural harm from the boreholes, no unacceptable visual impact, and policy compliance, recommending dismissal. The Minister accepted the recommendation on 19 December 2025, upholding approval with conditions limiting above-ground works.
Precedent Value
Appeals against approvals rarely succeed without strong evidence of harm; third parties cannot block sustainable infrastructure via unrelated grievances. Applicants should provide engineering evidence and risk assessments proactively.
