DEFA Planning granted Registered Building Consent (25/00103/CON) for demolition of the existing kiosk, turnstile and gates to facilitate a new visitor centre already approved under PA25/90093/B. Garff District Commissioners appealed, arguing the structures contribute positively to the Laxey Conservation Area and setting of the Laxey Wheel Ancient Monument. The inspector assessed the impact on the Conservation Area character (defined by Victorian industrial heritage) and the Monument's setting, concluding the 1980s structures make neutral contribution at best and their removal causes no harm. Policies including Strategic Policy 4, Environment Policies 35/39/40, and CA/2/CA/6 were found not breached. The appeal was dismissed on 15 December 2025, upholding approval with conditions for works commencement and storage of gates/turnstile.
Precedent Value
This appeal confirms that non-historic structures (even well-integrated/cherished) in Conservation Areas around key Monuments contribute neutrally if unrelated to defining heritage; applicants succeed by evidencing no harm to character/setting and tying to approved schemes. Future appellants must prove historic/architectural linkage to overcome retention presumption under CA6.
