The original application was refused by the Planning Committee on 28 April 2025 for three reasons relating to non-compliance with GP3, HP11, and HP4 due to the site's countryside location, the barn's structural deficiencies requiring extensive rebuilding, and lack of architectural/historic/social interest. The appellant argued the barn was redundant, structurally capable of renovation per structural report, within Churchtown settlement context, and would provide family accommodation with visual improvements. The inspector found partial policy conflict on principle (no architectural value, countryside location) but significant benefits in visual enhancement, no harm to amenity/highway/biodiversity/drainage, and environmental improvement justifying approval despite strict policy terms. The appeal was allowed subject to conditions including access/parking, materials, curtilage definition, lighting, drainage, bird box, and landscaping.
Precedent Value
Sets precedent that for non-traditional countryside barns near settlements, structural reports showing renovation feasibility plus visual/environmental benefits can justify approval despite lacking heritage value and requiring substantial works, overriding strict GP3/HP11 where no other harms arise. Future applicants should prioritise engineering evidence, amenity/no-harm cases, and contextual benefits over unsubstantiated heritage claims.
