In the absence of any detailed grounds of appeal being submitted by the Appellant, the Case Officer report will present the case of the authority, with a rebuttal being provided once a copy of the Appellant's Statement of Case has been received.
The original application for a replacement dwelling was refused because the existing building had been demolished, rendering it new residential development in the countryside contrary to policies including GP3, Housing Policies 12 and 13, and Strategic Policies 1, 2, and 10. The appellant argued the site qualifies as previously developed land (PDL) under GP3(c) and the IMSP Glossary, with recent demolition due to safety issues, supported by prior approval for refurbishment (PA22/01470/B), design compliance, and no objections from consultees. The inspector acknowledged strict policy conflict under GP3 as no building remains but found the recent demolition, site history, design merits, environmental improvement, and lack of objections outweighed the objection, recommending allowance. The Minister accepted the recommendation, approving the appeal subject to conditions on access, landscaping, materials, and lighting.
