The original application for demolition of a derelict structure and erection of a three-storey 4-bedroom dwelling with garage and landscaping was recommended for approval by the officer but refused by the Planning Committee on 24 February 2025 for reasons of overdevelopment, failure to respect surroundings under GP2(b), and adverse overbearing/overshadowing impact on Minerva Cottage under GP2(g). The appellant argued the stepped design responded to site topography and varied local character, improved upon the derelict site, and included mitigations for amenity with no undue harm, supported by Port Erin Commissioners and statutory consultees. The inspector acknowledged no issue with principle of development on brownfield land, design quality, biodiversity, or drainage but found the proposal's scale and proximity (under 2m to Minerva Cottage sunroom) would visually dominate and overbear that property, harming street scene character and amenity, with additional moderate highway safety concerns from potential excess parking demand. The appeal was dismissed, upholding the refusal, though conditions were suggested if permission were granted.
Precedent Value
Even on brownfield in settlements with officer support, proposals must rigorously demonstrate no dominance/overbearing to immediate smaller neighbours; closer side distances require stronger design justification. Future applicants should prioritise 3D visualisations, daylight assessments and neighbourly scaling over maximising plot coverage.
