Private residents (owners of 2 Glen View and Holly Bank) submitted objections to the appeal against non-determination for demolishing Leyton (a registered building) to build two new houses, citing heritage value, design issues, density, access, trees, and ecology; no statutory consultees responded.
Key concern: Demolition of Leyton, a registered building of special architectural and historic interest
Owner of 2 Glen View South Cape Laxey
ObjectionNotwithstanding the above, the essence of my comments remains unaltered; Please save this superb historic building and refuse the application
Conditions requested: If the appeal is successful elevations on Drawing 23/103/PL01 for Plot 2 are renamed in accordance with the alignment for both plots shown on Drawing 23/103/PL02
Owners of Holly Bank Little Switzerland
ObjectionWe wish to object to the appeal against the construction of two new houses to replace Leyton; We cannot understand how this application is even being considered; Surely the owners should, in fact, be under instruction to remedy the neglect suffered by the property over recent years
The original application for construction of two new houses to replace the existing single house at Leyton, Victoria Road, Douglas, was not determined by DEFA Planning due to the building's registration as a protected building in 2024, with related de-registration appeal dismissed. The appellant argued the building lacks special interest, is dilapidated, and proposed dwellings would respect the area, while the Council defended refusal primarily on heritage loss, design, ecology, drainage, and other issues. The inspector found the demolition of the registered Arts and Crafts building unacceptable without sufficient justification, replacement dwellings lacking authenticity and failing to enhance the area, and noted unresolved ecology and drainage concerns, outweighing other matters. The appeal was dismissed by Mr Lawrie Hooper MHK on 4 July 2025, upholding the putative refusal reasons.
Precedent Value
Demonstrates strong statutory presumption against demolishing recently registered buildings requires robust evidence (surveys, viability, retention efforts) to overcome. Superficial stylistic pastiche insufficient for enhancement; future applicants must provide comprehensive technical info on ecology/drainage even if secondary.
