The original application (22/01134/A) sought approval in principle for residential development on a 1.98 hectare site in Foxdale, granted by the Planning Authority subject to a Section 13 Agreement for affordable housing and open space. Patrick Parish Commissioners appealed, arguing flood risk, infrastructure capacity, lack of housing demand, conflict with the emerging North and West Area Plan designating the site as open space, ecological value, and mining contamination/archaeology. The applicant (Yorkfields Limited) defended the proposal citing the site's allocation in the adopted Foxdale Local Plan 1999, limited weight to the emerging plan, housing needs under the Strategic Plan, and no objections from statutory consultees. The inspector found the principle of development acceptable under current development plan policies, gave little weight to the emerging Area Plan due to potential further modifications, dismissed prematurity concerns, and concluded other issues (flooding, contamination, ecology, infrastructure) could be addressed at reserved matters stage. The Minister accepted the inspector's recommendation to dismiss the appeal and uphold the approval subject to detailed conditions.

Emerging plans carry minimal weight if subject to further change post-examination; current development plan allocations remain decisive absent other material considerations. Applicants/parishes should prioritise evidence from statutory bodies over local assertions, and note that modest schemes in allocated sites face low prematurity risk.
