The original application for the triple garage was approved by the Planning Committee on 7 May 2024 despite neighbour objections on visual impact, flooding, and amenity. Neighbour Timothy Swift appealed, arguing the garage's scale, massing, visual impact on townscape and Conservation Area, adverse effects on sea views, flooding risks from coastal overtopping, and amenity/highway issues. The applicant and Department defended the scheme as subordinate to the main house, screened by boundaries, compliant with policies, not in flood zone, and better than permitted development fallback. Inspector Jennifer Vyse, following a public inquiry on 24 September 2024 and site visit, found no harm to character/appearance or unacceptable flood risks, rejecting appellant arguments and recommending dismissal. Minister accepted the recommendation on 6 November 2024, upholding approval with standard time limit condition.
Precedent Value
Affirms approval for ancillary outbuildings matching host dwelling design in urban/coastal settings outside flood zones/Conservation Areas, even with neighbour objections, if no policy conflict and fallback available. Applicants should document matching details, consultee responses, and permeability calcs; third parties need evidenced off-site harms.
