Town and Country (Development Procedure) Order 2005
Mr & Mrs Morris Ardwhallin House West Baldwin Braddan IM5 5EU
In pursuance of powers granted under the above Act and Order the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:
Name: Mr & Mrs Morris Proposal: Erection of garage and workshop at: Ballig West Baldwin Isle Of Man IM4 5EU
which was considered on 19th February 2009, for the reasons set out below.
Date of Issue: 20th February 2009
Murray House Mount Havelock Douglas
Reason(S) For Refusal:
- By reason of its size the proposed building is considered to be harmful to the amenity of the area and not suitably subservient to the residential development that it purports to serve. As such, the proposed development is contrary to the provisions of General Policy 2 and Environment Policy 2 of the Isle of Man Strategic Plan 2007.
- The planning application fails to adequately demonstrate the impact of the proposed development on existing trees contained within the application site. As far as can be assessed from the submitted information it is apparent that the proposed development would lead to the loss or damage of existing trees. As such, the proposed development is deemed to be contrary to the provisions of Environment Policy 3 of the Isle of Man Strategic Plan 2007.
This decision was made by the Acting Senior Planning Officer in accordance with the authority delegated to him under Article 3(13) of the Town and Country (Development Procedure) Order 2005.
