The officer considered the proposal a poor replication of the traditional Manx cottage and adjacent properties, citing irregular window lines (two sizes on upper floor), wider porch with toilets adjac…
Housing Policy 18
One objector cited HP18 supporting retention/re-use of habitable houses, questioning why existing could not be retained. Officer noted no justification provided for demolition but focused assessment on design/amenity/highways impacts rather than directly testing policy.
Rushen Parish Commissioners objected due to inadequate plans, inappropriate design, and access issues; Highways Division requested deferral due to insufficient access details; public representations from J Scott and Judith Walker raised objections on overbearing mass, privacy, design, and access.
Key concern: inadequate plans lacking measurements, heights, footprints, and access details
Rushen Parish Commissioners
ObjectionThe Commissioners are of the opinion that the plan is inadequate for them or any members of the public to be able to understand what size the property will be and the impact on the area.; The Commissioners suggest that the applicant submits a more appropriate design and gives adequate measurements and comparisons to make the plans easily understood.
Conditions requested: roofing should be in slate to fit in with neighbouring properties
Highways Division
Conditional No ObjectionThe Highways Division originally asked for a deferral of the decision on the grounds that: Insufficient access information provided for a 30mph highway. No information provided on whether shared or individual access. Horizontal and vertical splay not provided; Without this information the Department is unable to comment further on this application.

The original planning application 08/02015/B to demolish an existing Manx stone cottage in poor repair and replace it with two 4-bedroom semi-detached dwellings with associated parking was refused by the planning authority. The appellant, Ravenhill Resources Ltd, represented by MP Associates, lodged an appeal on 9 December 2008 requesting an inquiry hearing, which was scheduled for 22 April 2009. The proof of evidence directly addressed six reasons for refusal (R1-R6), arguing the existing building's poor condition, comparable scale and height, adequate parking and privacy, improved light for neighbours, and superior living standards. The council was requested to submit their case by 19 January 2009. The appeal was withdrawn on 24 April 2009, so the original refusal stands and no inspector analysis or decision was issued.
Precedent Value
This withdrawn appeal provides no precedent as no inspector decision was reached. Future applicants should note that even with detailed rebuttals to refusal reasons and a scheduled inquiry, external factors can lead to withdrawal, potentially preserving resources or due to resolved issues.
