The application site represents the curtilage of the semi-detached, single storey property 25 Slieau Whallian Park, St Johns. The property is located approximately half way into the estate on the left hand side.
The site is located within an area identified as being Predominantly Residential Use by the St Johns Local Plan. The site is not within a conservation area.
The following previous planning application is considered relevant in the assessment and determination of this application:
PA 04/01266/B sought approval for the erection of a conservatory and the creation of patio doors to the rear elevation and the creation of a new bathroom window. This was approved.
The Department of Transport Highways Division does not object to this application.
German Parish Commissioners have not commented on this application.
Mr P Holmes of 26 Slieau Whallian Park objects to this application stating that the fence blocks his view of the estate and there is no justification for the fence given the existing boundary wall.
This application seeks retrospective approval for the erection of a fence on the inside of the existing brick boundary wall. The applicant states that the fence would not exceed 2 metres above the lowest side of the wall (that being the outer side abutting the pavement). It is proposed to stain the fence to match those sections that have already been stained.
ASSESSMENT
The main issues to be considered in the assessment of this application are the impacts of the fence upon the existing property, neighbouring properties and the surrounding area in general.
In relation to the existing property, the fence would provide additional screening to the existing brick boundary wall. On staining the fence it would become a feature not dissimilar to other fences in the surrounding area. It is considered that the fence would reduce overlooking of the rear of the property from adjacent dwellings.
In terms of neighbouring properties, the applicant proposes to reduce the fence so that it does not exceed 2 metres as measured from the pavement side of the boundary wall. It is judged that at this height, the proposed fence would not adversely affect the amenity of neighbouring properties.
The fence would be stained so as to have a uniform finish and the reduction in height would improve the existing appearance which is unfinished and does not enhance the area. Conditions should be attached limiting the height to 2 metres and requiring the fence to be stained within a set period of time.
RECOMMENDATION It is recommended that the application be approved. PARTY STATUS

This approval relates to the erection of a timber fence on the inside of the boundary wall of 25 Slieau Whallian Park as shown by the plans and information 1737/1, 1731/2, Photographs and Support Letter.
Within 28 days of the approval notice becoming final, all fencing currently erected must be lowered to a height not exceeding 2 metres as measured from the pavement side of the boundary wall. All fencing to be erected must not exceed 2 metres in height as measured from the pavement side of the boundary wall.
On construction, all fencing must be stained so as to match the fencing shown on Photograph No. 1 submitted and date stamped 8th September 2008.
I confirm that this decision accords with Government Circular No 32/07 (Delegation of Functions to Senior Planning Officer) and GC 33/07 for Advertisements.
