Officer's Report
The Site
The site represents the curtilage of the Whitestone Garage - a car sales and maintenance facility located on the north western side of the A5 Douglas Road within the village of Ballasalla. The site is characterised by a large, low, L-shaped building towards the south western end of the site and a large area dedicated to the outside display of vehicles for sale. The frontage to the public highway is generally open with a variety of signage within the site.
Planning Status
The site lies within an area designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 as Predominantly Residential.
Planning History
There has been a number of applications for signage and various garage-related developments, the most recent of which was a pennant sign (PA 06/1080) and other signage (PA 06/0488) both approved.
The Proposal
Proposed now is the erection of two flagpoles at the front of the site. These will be 8 m in height with long Mercedes flags displayed upon them. The poles will be fibreglass. The flagpoles will be erected either side of an existing flagpole.
Representations
Malew Parish Commissioners and Department of Transport raise no objection to the application Manx Electricity Authority recommends consultation regarding existing electricity supplies within the site. This is a matter for the contractor on site and should not be referred to in the planning decision notice.
Assessment
The flags will be consistent with the advertising elsewhere on the site and not detrimental to the streetscene within the village. The flag poles are slim and will not affect visibility for those emerging from the site and there is no objection from the Department of Transport Highways and Traffic Division in this respect.
Party Status
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
Manx Electricity Authority raise issues which are related to working practices and as such should not be afforded party status in this instance.

C 1. a) The development hereby permitted shall be commenced before the expiration of four years from the date of this notice. b) Any advertisements displayed, and any site used for the display of advertisements, shall be maintained in a clean and tidy condition to the reasonable satisfaction of the Department. c) Any structure or hoarding erected or used principally for the purpose of displaying advertisements shall be maintained in a safe condition. d) Where an advertisement is required under these Regulations to be removed, the removal shall be carried out to the reasonable satisfaction of the Department. e) No advertisement is to be displayed without permission of the owner of the site or any other person with an interest in the site entitled to grant permission.
f) No advertisement shall be sited or displayed so as to obscure, or hinder the ready interpretation of any traffic sign, railway or tramway signal or aid to navigation by water or air, or so as to render hazardous the use of any highway, railway, tramway, harbour or aerodrome.
C 2. This permission relates to the installation of two flagpoles with advertising flags as shown and described in the information and plans received on 9th September, 2008.
