The application site represents the recently constructed Peel Inner Harbour Marina, East Quay, Peel. The site extends north from the bridge which provides access to West Quay.
The harbour itself and West Quay, is located outside the designated Peel Conservation Area as is the proposal site. However the Conservation Area designation runs along East Quay, immediately.

adjacent to the site. As such it is judged that the application must be assessed against the following policy contained within the Strategic Plan:
Environmental Policy 36, which states:
"Where development is proposed outside of, but close to, the boundary of a Conservation Area, this will only be permitted where it will not detrimentally affect important views into and out of the Conservation Area."
The following previous planning applications are considered relevant in the assessment and determination of this application:
PA07/00910/B sought approval for an Inner Harbour Marina development comprising of reclamation of land at the southern end of the harbour to provide a boat park and car parking, installation of fully serviced floating pontoons, erection of a toilet / shower block with offices above, highway amendments and construction of a concrete maintenance platform. This was approved.
REPRESENTATIONS The Department of Transport Highways Division does not object to this application. Peel Town Commissioners do not object to this application. The Manx Electricity Authority has submitted a note relating to overhead lines/underground cables.
The Department of Agriculture Fisheries and Forestry has requested that a condition be attached to any subsequent approval relating to the proximity of development to the watercourse.
Mr Crookall MHK has requested that he be kept informed of the outcome of this and all other applications within Peel.
This application seeks approval for the erection of a temporary amenity building at the southern end of the marina. This would be single storey and would provide male and female changing rooms with showers and toilets. The building would have a flat roof and would be finished with a combination of timber cladding and a blue/grey cladding. A ramp would provide pedestrian access to the building.
PA07/00910/B included a building to be sited on the existing car park adjacent to the inner harbour marina. This was to be a two storey building which would provide changing rooms, toilets and shower facilities to serve the marina development. The first floor was to contain offices.
Whilst the marina has been progressed to near completion, the Department of Transport Harbours Division has been requested by the Capital Projects Unit of Treasury to review the area surrounding the harbour. It has been decided that the approved building will not be built until a decision has been made as to how the area may be developed. However as the marina is nearing completion, there is still a need for an amenity building. This application proposes a temporary amenity building to be used for a period not exceeding 5 years from March 2009. Any future re-development of the adjacent car park site would incorporate a permanent toilet/shower facilities to serve the marina. If the re-development of the site is not deemed viable, the original approved amenity building would be constructed.
The main issue to be considered in the assessment of this application is the impact of the building upon the surrounding area, particularly the adjacent Conservation Area. Regard must be had to the fact that the proposed building, if approved would be in place for a limited period, albeit a relatively long period of 5 years.

The building itself would have the appearance of a temporary "portacabin" type structure however the proposed finishing materials would result in a higher quality appearance more sympathetic to the surrounding area. It is judged that the proposed building would be acceptable in this location for a limited period of 5 years. A condition should be attached requiring the removal of the building within a reasonable time period once the 5 year temporary approval has expired.
CONSERVATION OFFICER'S SUPPLEMENTARY REPORT: I have considered the content of the application with particular consideration to Policy CA/2 SPECIAL PLANNING CONSIDERATIONS as set out within Planning Policy Statement 1/01, Policy and Guidance Notes for the Conservation of the Historic Environment of the Isle of Man.
Proposed is the erection of a temporary amenity building on the previously approved Boat Park in Peel. I agree and endorse the assessment of the Planning Officer. I am content with its erection only on the basis that it is temporary and approved for five years. I therefore recommend approval of these proposals.
It is recommended that the application be approved.
It is considered that the following parties, who submitted comments, accord with the requirements of Planning Circular 1/06 and are therefore, afforded Interested Party Status:

This temporary approval relates to the erection of a temporary amenity building as shown by the plans and informationU1426/01B, Support Letter, Brochure and Completed Checklist submitted and date stamped 16th July 2008 and Applicant Letter, PA21 REV a and PA 22 REV A submitted and date stamped 26th August 2008.
C 3. The building must be finished in timber cladding and blue/grey cladding as shown on drawing U1426/01
C 4. The building may be used for a period of 5 years commencing from 1st March 2009. Within 3 months of the expiry of this approval, the building and all associated fixings and infrastructure must be removed from the site.
C 5. The building may be used only as indicated on the approved plans.
