The site represents the curtilage of the public conveniences in Port Erin, located on the Lower Promenade between Water Edge and White Cottage and at the foot of a grassed slope or broogh leading from the upper promenade (Shore Road) alongside the Falcon's Nest Hotel. The site accommodates the toilet building, car parking and pedestrian access to the upper promenade around the southern edge of the building and to the north in the form of a zig zag path.
The existing building has a slated hipped roof and split slate facing blocks with high level square windows and a front central clad panel with horizontal windows above.
The site lies within an area designated on the Port Erin Local Plan of 1990 as Tourism/Residential. The Written Statement accompanying the local plan includes reference to this general area as one of "interest" where "maintenance or refurbishment may be encouraged, particularly at upper levels. Mixed use will be permitted where appropriate" and where special attention should be paid to proposals for replacement buildings (paragraphs 9.4 and 9.7).
Permission was granted for alterations to provide disabled persons' facilities under PA 87/0020 and further alterations to provide disabled persons' facilities under PA 02/0169.

Now proposed are further refurbishment works which will make provision for a central disabled person's toilet which will also serve as a baby changing facility with a centrally positioned access from the front, together with a new access from the front to serve the male and female toilets on each side of the disabled persons' facility. A new cleaner's/Commissioners' store is proposed within the northern part of the building. The existing roof is to be repaired and a new projecting canopy added the indicate the access to all the toilets, a new rough cast rendered finish to replace the split slate blocks and new balustrading and a ramp in front of the building supported by a new Manx stonefaced retaining wall. The wall to the south is to be extended and the entrance path formalised. The wrought iron gates which previously gated the entrance to the male toilets is to be replaced by a timber door and the former entrance to the female toilets is to be blocked up.
Port Erin Commissioners, who are also the applicant, recommend that the application is permitted.
The policy in the written statement of the local plan encourages refurbishment and enhancement of properties in this area of interest and at present the building is one of the poorest structures in visual terms, in the area. The proposed changes, particularly the removal of the split slate blocks will greatly enhance the appearance of the property and the provision of a central shared entrance will open up the facility rather than having entrances around the side of the building which is seldom inviting or salubrious. Access to the facility will be much easier for those disabled users which is to be encouraged generally, but particularly in such a popular public area.
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
