The site represents field which lies immediately to the west of the Cordeman Lane, which runs north from the Bayrauyr which links St. Mark's with the Ballamodha (A3). Also defined incompletely in blue is other land which is associated with the application and farmed by the applicant.
The site lies within an area designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 as white land, that is, not designated for development.
There have been numerous applications submitted in respect of this site: PA 02/0091 - creation of hardstanding - permitted PA 02/2413 - erection of implement store with wc - permitted PA 04/2285 - erection of farm shop - permitted on appeal PA 06/0303 - erection of agricultural buildings - permitted PA 06/0830 - erection of two agricultural worker's dwellings - refused PA 06/1320 - erection of farm worker's dwelling - permitted on appeal PA 08/0770 - amendments to farm dwelling - permitted
Now proposed is the erection of an agricultural building - amending the permission already granted by moving the building around 45 m to the east and of the same size, height and appearance, that is 9.3 m wide and 27.3 m long and 6.2 m in height, finished in profiled sheeting.
Isle of Man Water Authority recommend that there is a water main which will be affected by the proposed development. The applicant's agent has been advised of this. Following discussions, the Water Authority have withdrawn their objection.
Malew Parish Commissioners have withdrawn their earlier concerns and now have no objection to the application.
The building already has permission some 45 m to the west and the visual impact from the change in the location is not significant. There is a dwelling opposite the new site, a dwelling which is not in the ownership of the applicant. However, access to the farm group which is being created, is right next to this dwelling and as such the impact of the barn, closer to the dwelling, is not unacceptable. The barn will be 35 m to the north and there is a farm shop alongside which has approval.
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
Isle of Man Water Authority raise an issue which is a material planning consideration as the water main will be directly affected by the proposed development and as such the Isle of Man Water Authority should be afforded party status in this instance.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This permission relates to the construction of an agricultural building as shown in drawings AT 777.1 Rev 1 and the location plan, both received on 11th June, 2008 as a replacement for the barn approved under PA 06/1139.
C 3. The building must only be used for agricultural purposes.
C 4. The buildings must be clad in dark coloured sheeting (dark green, dark grey or dark brown).
