ON APPEAL: PA08/774/B – Mr Alan Teare – Extensions to dwelling with new driveway and access onto highway, Garthcote Ballakillowey Road, Colby, IM9 4BD.
I refer to the recent appeal in respect of the above planning application.
In accordance with the provisions of the Town and Country Planning (Development Procedure) Order 2005, I am enclosing herewith a copy of the report of the person appointed to consider this appeal.
The Minister has considered the report, concurs with the appointed person's conclusions, and accepts the recommendation that the appeal should be dismissed. Accordingly, he has directed that the decision to approve the application under Article 6 of the Town & Country Planning (Development Procedure) Order 2005 be upheld subject to the conditions imposed by the Planning Committee and the additional condition as stated in paragraph 12 of the Inspector's report. Formal notice of approval is attached.

TO: Mr Alan Teare Garthcote Ballakillowey Road Colby IM9 4BD [Copies as per Circulation List]
In pursuance of his powers under the above Act and Order, the MINISTER for Local Government and the Environment, following report by the appointed person, does hereby APPROVE the application by Mr Alan Teare for extensions and new driveway and vehicular access at Garthcote, Ballakillowey Road, Colby subject to compliance with the following conditions:-
- The development hereby permitted shall commence before the expiration of four years from the date of this notice.
- This permission relates to the alterations and extensions to the dwelling and the creation of new access and parking area, all as shown in drawings AWT-02, -/03 and -/04 all received on 15th April 2008 and AWT-01 received on 27th June 2008.
- Prior to the commencement of any development, details of the location and height of a screen fence along the boundary adjoining Cronk Glass, as well as the levels of the proposed driveway, shall be submitted to and approved in writing by the Planning Authority. The fence shall be erected prior to any use of the access and parking area as such.
