The Site
The site represents the residential curtilage of two existing properties, number 86 and 88 Malew Street. The properties sit on the north eastern side of the street and back onto long rear gardens - 18m long - which in turn back onto Paradise Field - a large detached property sitting in its own grounds with associated outbuildings.
Planning Status
The site lies within an area designated as Residential on both the adopted Castletown Local and draft Castletown Area Plans.

Proposed here is retrospective permission for the erection of a wall, steps and a fence. The application has arisen following a complaint regarding fencing which was erected on the rear boundary which appeared to be very high as viewed from the property to the south. This application refers to the fence which is to be erected between number 86 and 88, steps up from the rear of the property which is lower than the level of the ground and a retaining wall. There are no plans showing the extent of the rear yard area, how far away from the rear elevation the walling has been built.
Further plans have been submitted and the neighbours notified. These plans show measurable distances and dimensions of the fencing, excavation and walling shown in the photographs.
Representations
Department of Transport Highways and Traffic Division indicate that they have no objection to the application.
Assessment
The proposal has little impact on the amenities of adjacent properties and the walling, excavation and fencing is not unusual within a residential rear streetscene. There are no objections to the proposal.
Party Status
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
