PART 2
Town and Country Planning Act 1999
Town and Country (Development Procedure) Order 2005
Fiona Wade 30 Douglas Street Peel Isle Of Man IM5 1BB
In pursuance of powers granted under the above Act and Order the PLANNING COMMITTEE of the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:
Name: Fiona Wade Proposal: Change of use and extensions to commercial outbuilding to create a residential dwelling at: 30 Douglas Street Peel Isle Of Man IM5 1BB
which was considered on 14th August 2008, for the reasons set out below.
Date of Issue: 18th August 2008
Murray House Mount Havelock Douglas
Reason(S) For Refusal:
- Insofar as can be ascertained from the submitted drawings, the proposed extension of the existing single storey outbuilding to create a separate residential unit would fail to protect to an acceptable level, the residential amenity of Number 30 Douglas Street. The proposal would also result in a new residential unit with a poor outlook, shared outdoor space and access via a rear service lane. As such the proposal fails to accord with General Policy 2, specifically parts (g) and (h) and Environmental Policy 42 of the Isle of Man Strategic Plan.
- The proposed development would have an adverse impact upon the character of the Conservation Area and would lead to pressure for similar inappropriate development along the service lane to the rear of Douglas Street.
- The submitted drawings are not of a sufficient standard to allow a full assessment of the proposed development.
