07/01794/B Refusal Decision Notice
Town and Country Planning Act 1999
Town and Country (Development Procedure) Order 2005
Promoor Ltd 51a Victoria Street Douglas IM1 2LD
In pursuance of powers granted under the above Act and Order the PLANNING COMMITTEE of the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:
Name: Mr T Foster Proposal: Conversion of outbuildings to a dwelling at: Elgin Jacks Lane Port E Vullen Ramsey Isle of Man IM7 1AW
which was considered on 25th January 2008, for the reasons set out below.
Date of Issue: 29th January 2008
Murray House Mount Havelock Douglas
Deputy Secretary to the Planning Committee
Reason(S) For Refusal:
- By reason of the extent of the alteration and extension of the building it is concluded that the proposed development fails to accord with Housing Policy 11 of the Isle of Man Strategic Plan 2007, resulting in a building that neither reflects the original building nor is traditional in appearance to compensate.
- By reason of the distance between the two properties, its internal layout and the lack of opportunity to provide suitable screening or boundary treatment it is concluded that the proposed dwelling will result in an unacceptable adverse impact on the residential amenity of the neighbouring property known as Elgin Stables.
This decision was made by the Planning Committee constituted in accordance with Article 3(1) of the Town and Country Planning (Development Procedure) Order 2005.
The decision contained in this notice does not become final until either;
