The site represents part of a disturbed site which lies to the south of the Stoney Mountain Road, to the south of Foxdale village. The site is accessed via a long lane which passes a dwelling and industrial shed. The site has been the subject of a number of applications which have sought and been granted approval for the use of the site for the bulk storage of cement (PA 00/1442) and inert material recycling (PA 01/1784). Permission has also been sought and granted for a landscaped earth mound to screen inert material recycling unit (PA 04/0125). Permission was refused for the erection of light industrial units (PA 01/1783) as the land is not designated for industrial development. This last plan showed the Minimix operation to the south of the proposed industrial units.
The application for the change of use of part of the site for inert building materials recycling was permitted on appeal where the Inspector noted "Although the land is not designated for any industrial type uses, it is a matter of fact that it has had a valid approval and use in the past for industrial type uses and new industrial operations have been approved on the cleared land of which the appeal site forms part. The use of the site for the proposed recycling unit for inert materials seems to me to be compatible with the adjoining concrete mix plant operation. Access from the Stoney Mountain Road already exists..." (his paragraph 13).
The site is clearly part of a larger disturbed area which has permission for recycling and concrete storage.
The site lies within an area designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 as Open Space ("white land").

Proposed now is the erection of a building 20 m by 25 m close to ( 2 m from) the north eastern boundary of the site. The building will be 7.1 m to the ridge and finished in green coloured sheeting for the walls and grey sheeting on the roof. The building will have two roller shutter doors and three pedestrian doors throughout the building with a mezzanine floor over the south eastern part of the building.
Malew Parish Commissioners indicate that they have no objection to the application.
The site has authorised use for the storage of cement. As such, the proposed building, which will be used for the storage of cement is not objectionable. The critical issue is the visual impact of a new building. Whilst there are no buildings on the site, I am aware that the adjacent site operator is considering the erection of buildings on his recycling site. There are, in any case, many structures and vehicles on site which do not contribute positively to the appearance of the site. The erection of a building could assist with the tidying up of the site. Whilst this will create a structure which is arguably more permanent that the present structures, and perhaps will make permanent a use which may at some time be relocated, the area in which the site is located has become characterised by industrial and untidy processes which are probably better located off the public highway in this location rather than in the centre of Foxdale village where such development is clearly visible.
There are no objections to the proposal.
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This permission relates to the erection of a shed as shown in drawing WL/08/1070/1 to be used for the storage of cement in association with the use of the site as defined in drawings WL/08/1070/2 and -/3 for the mixing and storage of cement and concrete and associated products and processes.
