The officer assessed the proposal against General Policy 2 (GP2), Environment Policy 35 (EP35), and Transport Policy 7 (TP7), concluding it complies overall as the rear extension and terrace addition …
General Policy 2
Requires development to respect site/surroundings in siting/layout/scale/design, not adversely affect character, amenity, views, habitats, or highway safety. Officer found rear extension/terrace fits seamlessly into harbour/industrial rear character, modern materials acceptable given precedents, privacy screen mitigates amenity, parking retained near bus stop.
Environment Policy 35
Permits only development preserving/enhancing proposed Conservation Area character. Rear works do not detract as site not prominent in CA appraisal, ties into diverse rear lane with modern features; front enhancements supported, no objection raised.
Transport Policy 7
Requires parking per standards (1 per 15sqm for leisure). 20sqm addition requires 1 extra space but relaxed due to bus proximity (84m), 5 spaces retained via reconfiguration, Highways no objection; terraces excluded from calculation.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.
Privacy screen details
Prior to the use of the first floor terrace approved as part of this application, details of a privacy screen which shall have a minimum height of 1.7m and erected on the southern elevation of the terrace shall be submitted to and approved in writing by the Department. The development shall not be carried out other than in accordance with the approved detail and shall thereafter be retained as such. Reason: To safeguard the amenities of adjoining occupiers from overlooking and loss of privacy.
No Highway Interest; sufficient space with parking reconfiguration, linked trips reduce impact, bad neighbour issues resolvable by joint working
Port St Mary Commissioners objected to the application due to loss of parking, access restrictions for large vehicles to the fish factory, and increased congestion. DOI Highways raised no objection after review of amended plans, noting reconfiguration of parking and no net loss.
Key concern: loss of parking and restricted access for large vehicles to fish factory
Port St Mary Commissioners
ObjectionNME/RG proposed to object to the application on the grounds of loss of parking and the development will restrict access for large vehicles to the fisheries which will impact a business central to the Port. All in favour. Carried.
Port St Mary Commissioners
ObjectionPort St Mary Commissioners objected to the original Planning Application for the above and would like to make further objections and comments on the amended application; we strongly object; the current plan is detrimental to the surrounding area
Department of Infrastructure (DOI) Highways Division
No ObjectionNo Highways Interest; NHI on 31.12.21
Highways Development Control
No ObjectionHighways Development Control notes the additions uploaded on 4 February 2022 and advises that the Applicant indicates that there are no loss of parking spaces on building the extension. Instead, there is on-site reconfiguration of parking on the creation of the proposed sail store with one space intended to be repositioned towards Lime Street where there is currently no parking. There is sufficient space.; Linked trips are expected reducing the impact of new trip making to the site.
