Report of an Inquiry, held on the 13th July 2006, into appeals by Mr and Mrs C G Faragher and others against the planning approval granted to Hartford Homes Ltd., for the erection of 12 detached dwellings, estate layout and drainage on vacant land at Bradda View, Ballakilloway, Colby, Rushen.

The Appeal Site
- The site is a piece of vacant land of about 1 hectare (2.48 acres) which lies between Bradda View, Ballakeyll and Odin’s Way, within an estate known generally as Ballakilloway. The site slopes downwards to the south and contains some specimen trees within its boundaries. The boundaries are formed of a hedge, bushes and trees.
The Proposed Development
- It is proposed to develop 12 dwellings of 3 different detached types. Access would be from an extension of Bradda View. A revised site layout, drawing 02 revision C, was submitted at the Inquiry as had been submitted to the Planning Committee prior to its determination.
Planning History
- Under PA 04/2344 approval in principle was granted for residential development of this land. The application had indicated 11 plots but the Planning Officer had reported that this was not in accordance with the Local Plan development brief and no approval was given to the submitted layout. Attention was drawn in the decision notice to the Development Brief requirements that ‘The density and style of development shall be in keeping with existing residential development adjoining the site’.
