The officer assessed the proposal against the Kirk Michael Local Plan 1994, noting the site is mostly zoned 'Open Space (Agriculture)' not designated for residential development, contrary to Policy 5.…
Kirk Michael Local Plan Policy 5.9
Policy prohibits allocation of further areas for residential development beyond six specifically identified sites. Officer noted this site is not one of them and lies in Open Space zoning; no justification provided to override, especially given planning history.
Kirk Michael Local Plan Policy 12.4
Policy states no areas of open space should be released for development except those already proposed. Site zoned Open Space (Agriculture); development would release it without material change in circumstances since prior refusals.
Kirk Michael Local Plan Policy 5.10
Requires future residential proposals to incorporate appropriate open space in landscape schemes. Proposal provided only 169.625 sqm versus 960 sqm required (96 sqm per bedroom equivalent), creating shortfall.
Recreation Policy 3
Requires new residential development of 10+ dwellings to provide recreational/amenity space per Appendix 6 standards. Failed due to open space shortfall; indicative play area on unapplied-for land not counted.
Kirk Michael Local Plan Policy 12.5
Requires residential development to incorporate open space and landscaping. No details submitted but condition could address if approved; however, zoning overrode.
Part of site within zoned area; on balance no objection to principle as affordable homes using local kits.
No objection subject to conditions on connection to public foul system, no surface water to foul sewer, and compliance with Manx Sewers for Adoption.
Manx Electricity Authority and Department of Transport Drainage Division provided no objection responses with conditions related to utilities; Society for the Preservation of the Manx Countryside & Environment objected on zoning grounds; multiple local residents strongly objected citing zoning, highway safety, pollution, and loss of open space.
Key concern: Land outside zoned area for residential development per Kirk Michael Local Plan, Order 1994
