The application site forms the curtilage of 30 Douglas Street, Peel, a three storey terraced property with attic accommodation.
The application site is located within the Peel Conservation Area and within an area zoned as Mixed Use.
In addition to the general policies within the adopted Isle of Man Strategic Plan, the following policy is considered to be relevant:
Environment Policy 35: Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development.
There have been a number of previous planning applications in relation to the application site; however none of these are considered relevant in the consideration of this application; however the following applications are currently being considered by the Department:
PA 07/00747/C – Change of use of ground floor residential rooms to cafe, 30 Douglas Street.
PA 07/00749/C - Change of use from retail to a cafe, 30 Douglas Street
The application proposes the change of use of a room at the rear of the first floor for use as a holistic therapy centre. In addition, the application proposes the creation of off road parking to the rear of the property with access from the car park adjacent to Boilley Spittal. The creation of the car parking area would necessitate the demolition of a stone/block and block work wall to the rear and its replacement with a fence, indicating as matching the fences to the rear of Boilley Spittal.
The Department of Transport Highways Division advise that they do not oppose the application subject to there being one car parking space to serve the business. The Chief Fire Officer advises that a Note should be added to any subsequent approval. The Disability Access Officer submits comments relating to access which are primarily Building Control issues: The owner of 32 Douglas Street has submitted representation which relates primarily to land ownership in relation to the party wall and the area at the rear which is indicated for parking, and highway issues.
The application proposes the change of use of a room at the rear of the first floor to use as a holistic therapy centre. No further details have been provided in relation to the use. The building is the subject of a number of current applications, two of which propose the use of the ground floor as a café, which is considered would be compatible with the use proposed at first floor level.
Parking would be provided to the rear which would necessitate the demolition of an existing wall, which, whilst containing natural stone is not considered to contribute beneficially to the character and appearance of the area. An objection to the proposal has been received from the neighbouring occupier, however this mainly relates to civil issues of ownership although comments are made in relation to the implications of approving a parking area in terms of visibility.
The application site is located on the edge of the commercial area of Peel town centre (albeit within an area designated as Mixed Use), opposite the Post Office and within close proximity of a public car park and as such is not in a predominately residential area where one would not expect to find such uses. Whilst objections have been raised relating to highways implications and access, the Department of Transport Highways Division have not objected to the proposal, but requested the one parking space that is proposed as part of the scheme.
Subject to a condition in relation to the hours of operation and parking, the proposal is considered to be acceptable.
It is recommended that the application be approved.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This approval relates to the use of the room described as 2-RM-1 as a holistic therapy centre, as indicated on the plans submitted as part of this application date stamped 17th April 2007.
C 3. The use hereby approved may not be taken up until such time as the parking area is laid out and available for use. Such parking area must be retained thereafter for that purpose.
C 4. The holistic therapy centre hereby permitted shall not be open to customers outside 0900-1730 hours on Mondays to Saturdays. The centre shall not be open Sundays or Bank Holidays.
N 1. PRIOR to the commencement of any works, the developer must consult with the Fire Prevention Officer with regard to the provision of fire hydrants, and, prior to the occupation of any dwellings, must implement the recommendations arising from this consultation.

The applicant is advised that this approval does not grant or imply approval to carry out works on land outside their ownership or control.
