Landscaping implementation
All planting, seeding or turfing comprised in the approved details of landscaping must be carried out in the first planting and seeding seasons following the completion of the development or the occupation of the dwellings, whichever is the sooner. Any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased must be replaced in the next planting season with others of a similar size and species. All existing trees and hedges within the site to be retained must be adequately protected during the course of construction.

The original application PA 05/00910/B for 8 dwellings was approved by the Planning Committee but refused on appeal (05/2709) due to inadequate landscaping along boundaries with open countryside and the intrusive house on plot 8. A revised scheme for 7 dwellings (PA 07/00836/B) addressed these by removing plot 8, repositioning houses, narrowing the access road for additional planting strip, and increasing south-eastern planting, leading to Planning Committee approval on 19 July 2007. Appellant Mr W Kelly argues the revisions are insufficient, with plot 7 still protruding, inadequate planting depth, inappropriate materials, missing Energy Impact Assessment, and light pollution risks. The applicant Heritage Homes contends the scheme fully resolves prior concerns, complies with Port Erin Local Plan residential zoning and IoM Strategic Plan, and previous Inspector accepted principle of development and drainage. Inspector's prior analysis found drainage acceptable but landscaping decisive against approval. Current appeal documents present arguments without final decision.
