ON APPEAL: Planning Application No: 03/01604/B – Mr John Callaghan – Creation of a vehicle hardstanding and access in front garden of 13 Third Avenue, Onchan.
I refer to the recent appeal hearing in respect of the above planning application.
In accordance with the provisions of paragraph 7(5) of Schedule 1 to the Isle of Man Planning Scheme (Development Plan) Order 1982, I am enclosing herewith a copy of the report of the person appointed to hear this appeal.
I am directed to advise you that the Minister, having considered the report, has agreed to accept the recommendation of the appointed person. Accordingly, he has directed that the appeal be dismissed and that the decision of the Planning Committee to approve the application should be confirmed subject to the addition of the condition set out in the last paragraph of the report. Formal notice of this decision is attached hereto.

In pursuance of his powers under the above Acts and Order the MINISTER for Local Government and the Environment, following report by the appointed person, does hereby APPROVE the application by Creation of a vehicle hardstanding and access in front garden of 13 Third Avenue, Onchan subject to compliance with the conditions specified on the attached schedule and numbered 1-4 inclusive.
- This approval relates to the creation of off-road car parking in the front garden, as shown in the plan circulated on 16th December 2003 showing the driveway on the western side of the garden, grass and garden retained on the eastern side and a new tree planted in the retained garden area.
- The development hereby permitted shall commence before the expiration of four years from the date of this notice.
- The driveway must be finished in block paviors.
- Prior to the commencement of the development hereby approved, the details of the tree to be planted in the grassed area of the front garden shall be submitted to and approved by the Planning Authority and that tree shall be planted within the next planting season.
