The site represents the curtilage of Malew House, a large detached house situated on the west of Malew Road (A3) and to the north of Malew (St. Lupus') Church. The dwelling has a detached garage to the south.
The site lies within an area designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 as an Area of High Landscape or Coastal Value and Scenic Significance.
The following applications have been submitted in respect of this site:
PA 94/1491 - alterations and conservatory - split PA 95/0919 - erection of conservatory with integral swimming pool - permitted PA 95/1593 - replacement of flat roof with pitched roof - permitted PA 97/1180 - change of use of ground floor from residential to office - refused at review PA 02/1725 - erection of barn and stables - split PA 02/2440 - erection of agricultural barn - permitted PA 04/1162 - first floor extension and conversion of existing garage to tourist/guest accommodation - permitted PA 06/1588 - erection of garden room and extensions - permitted PA 06/2229 - erection of detached triple garage with living accommodation above - refused PA 07/0196 - erection of replacement entrance steps and creation of first floor doorway and balcony to front elevation - permitted and PA 07/0393 - alterations to roof - pending consideration (recommended for approval).
Proposed now is the erection of a garage - a re-submission of the previous application, PA 06/2229 which was refused for being too large and not unlike a new dwelling in the countryside. There were also concerns about the appearance of the large dormer on the rear.
I have since met with the applicant and he has explained that the accommodation is for a nanny and that he has vehicles which he wishes to accommodate under cover. The applicant agreed to consider amending the scheme to make it smaller and lower.
The plans submitted initially in this latest application now proposes the demolition of the existing garage to the rear of the house and the erection of a detached garage. Despite my concerns about its size, the building is actually 0.4m longer than the previous one and although it now only has one bedroom, there are two void areas which could easily be converted to additional bedrooms which was a concern previously. The building is 0.5m lower than previously.
I have contacted the applicant's agent with my concerns. The Society for the Preservation of the Manx Countryside and Environment comment on the similarity. Malew Commissioners have no objection to the application. The Fire Officer's comments relate to Building Regulations not planning.
Subsequent to my discussion with the applicant he has now amended the scheme by way of drawings 1248-02B and -03B received on 10th May, 2007. These show the removal of the first floor accommodation and a simpler, single storey three car garage with laundry and store room. This has no adverse impact and there are no implications of further living accommodation within this building. The description of the development should be amended to exclude the reference to additional living accommodation.
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
The Society for the Preservation of the Manx Countryside and Environment are not directly affected by the proposal and as such should not be afforded party status in this instance.
Fire Prevention Officer raises concerns regarding fire precautions which are not in this case a material planning consideration and as such should not be afforded party status in this instance.

N 1. PRIOR to the commencement of any works the applicant is advised to consult the Chief Fire Officer to ensure that adequate fire precautions are taken.
