The dwelling Ballakilley Cottage, Bride, is a two storey detached property which is located on the western side of the Main Road, and south of the St Bridgets Church. The application site (garden) is located approximately 7 metres north of the main dwelling house.
The boundary treatment shared with the neighbouring property Church View (northern boundary of site) consists of a 2.5 metre high hedgerow, along the eastern boundary the hedgerow increases in height to approximately 3 metres and the southern boundary comprises of a 1.8 metre high hedgerow.
The application site is within an area recognised as being an area of predominately residential use, under the Isle of Man Development Plan Order 1982. The site is not within a Conservation Area, however is within an area zoned as high landscape value or costal value and scenic significance.
The application proposes the erection of store / wood shed and car port. The proposal would have a total width of 7.8 meters, a depth of 4.2 metres and a maximum height of 3.4 metres. The proposal would have a painted render finish and a dark colour slate roof. The car port would access onto Ballakilley Close which also serves Ballakilley Cottage, 1 Ballakilley Close and 2 Ballakilley Close.
Highways Division:- Do not oppose
Bride Parish Commissioners have objected on the following grounds:- Far too large for the property area and surrounding garden. Plan looks smaller but actual size dimensions will prove to be a very large store.
The Drainage Division make no comment on the merit of the proposed development but request that an informative note be attached to any approval decision notice.
We have received no privately written representations objecting to the application.
Consideration needs to be taken to ensure the proposal would not cause significant adverse impacts to the detriment of neighbouring residential properties and/or have a detriment visual impact upon the surrounding area.
Firstly the boundary treatment surrounding the site and particularly the northern and eastern boundaries is substantial and would screen the majority if not all of the proposal were viewed from the public highway. The proposal is also setback from the building line of Ballakilley Cottage and Church View. I therefore consider from a visual standpoint the proposal would not have any adverse impacts to the detriment of surrounding area.
Regarding the impact upon neighbouring residential amenity and particularly Church View and 2 Ballakilley Close, I am of the opinion that the proposal would not have any adverse impacts upon residential amenity through loss of light and/or overbearing impact, due to the distance the structure would be from the properties, the height of the proposal, the size and the significant boundary treatment around the site.
The concern of the Bride Parish Commissioners that the property is far too large for the site is a concern I have taken into account, however I consider the proposal would not be too large, but rather it is a rather modest sized proposal for the site which would leave a considerable amount of garden space remaining.
For these reasons the proposals would seem appropriate in this location and therefore my recommendation is for an approval.
I consider that the following meet the criteria of Government Circular 1/06 and should be afforded interested party status:

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This approval relates to the submitted documents and drawings 00474/1 and 232-03 all received on 5th March 2007.
N 1. There must be No discharge of surface water (directly or indirectly) from this proposed development to any foul drainage system(s) so as to comply with the requirements of the Department of Transport Drainage Division and the Sewerage Act 1999.
It is noted that the surface water from the property is to be discharged via a soakaway. The use of soakaways are subject to Building Control approval and if this approval is not granted, the Drainage Division would not give permission for the discharge of surface water into the existing foul system and an alternative means of disposal would have to be sought.
I confirm that this decision accords with Government Circular Nos 44/05 (Delegation of Functions to Director of Planning and Building Control) and 47/05 (Delegation of Functions to Senior Planning Officer)
