Appeal Approval Decision Notice

Please reply to the Chief Executive Our ref: KAK/AJC 30th October 2007 Dear Sir/Madam, ON APPEAL: PA07/222 – Wai Ming Cheng – Relocation of existing kitchen extractor duct at the Silver Star Takeaway, 1 Waterloo Road, Ramsey. I refer to the recent appeal hearing in respect of the above planning application.

In accordance with the provisions of the Town and Country Planning (Development Procedure) Order 2005, I am enclosing herewith a copy of the report of the person appointed to hear this appeal.

The Minister has considered the report, concurs with the appointed person's conclusions, and accepts the recommendation that the appeal should be allowed. Accordingly, he has directed that the refusal of the application under Article 6 of the Town and Country Planning (Development Procedure) Order 2005 should be reversed, subject to the conditions stated in paragraph 10 of the inspector's report. Formal notice of approval is attached.

In pursuance of his powers under the above Act and Order, the MINISTER for Local Government and the Environment, following report by the appointed person, does hereby APPROVE the application by Wai Ming Cheng for Approval for the relocation of an existing kitchen extractor duct at the Silver Star Takeaway, 1 Waterloo Road, Ramsey, subject to compliance with the following conditions:-

1. The development hereby permitted shall commence before the expiration of 4 years from the date of this notice.

1. This approval relates to documents 00222/1 to 3 as submitted on 5 February 2007.

1. The vent hereby permitted shall not project by more than 1.0m from the roof slope of No 1 Waterloo Road, and its diameter shall not exceed 0.5m.
