The application site comprises of an existing office that is located between Elm Tree Road and Main Road in Onchan.
The planning application seeks approval for the change of use of the premises from an office to a dental laboratory. The application states that the operation is a production service and does not involve direct patient contact. Members of the public would be able to visit to have denture repairs but such work does not cover clinical dental work.
The existing use as an office was permitted by the previous planning application 98/02209/C.
Onchan District Commissioners recommend that the planning application be approved.
The Isle of Man Fire and Rescue Service recommend that the applicant discusses the provision of appropriate fire precaution measures with them.
The Isle of Man Water Authority requests that an informative note be attached to any approval decision notice.
The Disability Access Office requests that the needs of disabled access are taken into account.
The owner and/or occupant of 6 Wybourn Drive, who operates as Swift Dental Laboratory, object to the planning application. The grounds for their objection can be summarised as concern regarding commercial competition.
The application site is located within an area designated as being in mixed use (residential/office/retail) under the Onchan Local Plan.
Planning approval is required in this instance due to the proposed use, as a dental laboratory, need being within the same use class as the existing office. Indeed, as a dental laboratory does not fall within any of the specified use classes it would have to be classed as sui generis.
In terms of the acceptability of the proposed change of use it is considered that the proposed use is acceptable. The impact of its use is likely to be similar to that of the existing use and the site is located within an appropriate area that is recognised as being in mixed use. Accordingly, it is recommended that the planning application be approved.
In terms of the objection to the planning application it has to be acknowledged that commercial competition is not a material planning consideration and therefore cannot be taken into account in the assessment of a planning application.
It is considered that the following parties that made representations to the planning application meet the criteria of Government Circular 1/06 and should be afforded interested party status:

This approval relates to the use of the premises, as defined on the location plan date stamped the 11th December 2006, as a dental laboratory.

For a change in the water supply to a premises (domestic or commercial) the applicant should contact the Isle of Man Water Authority Byelaws Inspector (Michael Karren), telephone 695957.
N 2.
The applicant is recommended to contact the Isle of Man Fire and Rescue Service to discuss the provision of appropriate fire precaution measures.
